These Terms of Service (“Terms”) govern your use of the Primeform software application and related services (the “App”, “Primeform”, “Services”) operated by Vermeulen Group Ltd. (“we”, “us”, or “our”).
By creating an account or using the App, you agree to these Terms. If you do not agree, you must not use the App.
1. User Content
Primeform allows you to enter and store personal data, including fitness logs, check-ins, progress photos, messages, or other information (“Content”). You remain the owner of your Content. By using the Service, you grant Primeform a limited, non-exclusive licence to process, store and transmit your Content only as required to provide the Services to you. We will not use your Content for marketing, advertising or redistribution without your explicit consent. You are responsible for ensuring that any Content you submit is lawful and does not infringe the rights of others.
2. Accounts
You must provide accurate, complete and current information when creating an account. You are responsible for safeguarding your account and password. You agree not to use another person’s name, trademark or offensive usernames. If we believe your account breaches these Terms, we may suspend or terminate it.
3. Intellectual Property
All original content, features and functionality of Primeform (excluding user Content) are owned by Vermeulen Group Ltd and protected by copyright, trademark and other laws. Our trademarks may not be used without prior written consent.
4. Links to Third-Party Services
The App includes links to the official Primeform website (https://www.primeform.app). We do not include or endorse links to unrelated third-party services within the App.
5. Termination
We may suspend or terminate your access to the Services at any time if you breach these Terms. You may stop using the App at any time by deleting your account or uninstalling the App. If you don't delete your account, we will hold your data securely for you.
6. Limitation of Liability
To the maximum extent permitted by law, Vermeulen Group Ltd, its directors, employees, partners and affiliates shall not be liable for any indirect, incidental or consequential damages, including loss of data, profits or injury, resulting from your use of the Services.
7. Health Disclaimer
Primeform provides fitness and nutrition tools for general information only. It does not provide medical advice. By using Primeform, you acknowledge that exercise carries inherent risks of injury or death. You are responsible for assessing your own health condition before engaging in exercise. Consult a doctor before starting any new fitness programme. You agree that Primeform is not liable for injuries, health problems or death that may result from using the Services.
8. Subscriptions & Payments
Primeform offers a premium subscription service under the name Primeform that unlocks additional features.
Primeform is available as an auto-renewing subscription:
Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Renewal will be charged at the same price within 24 hours prior to the end of the current period.
Subscriptions can be managed or cancelled in your App Store or Google Play account settings. Any unused portion of a free trial, if offered, will be forfeited upon purchase of a subscription. All services are provided in English.
9. Disclaimer of Warranties
The App is provided “as is” and “as available” without any warranties of any kind. We do not guarantee uninterrupted or error-free service, or that results from using the App will meet your expectations.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes
We may update these Terms from time to time. If changes are material, we will provide at least 30 days’ notice where possible. Continued use of the App after changes take effect means you accept the new Terms.
